Terms of Service & User Agreement

1. Acceptance of Terms

By accessing, browsing, subscribing to, or using the GLD Racing website, subdomains, digital race cards, or associated data services (collectively, the "Services") operated by GLD Racing LLC, you agree to be bound by these Terms of Service. If you do not agree to all terms, you must immediately discontinue use of the Services.

2. Nature of Services: Information & Research Only

All materials, speed figures (GLD Speed Ratings), pace indices (Early Pace, Late Pace, Pace Differential), running styles (Speed, Off-Pace, Pack, Closer), Race Power benchmarks (RP), and pedigree evaluations (OWD) provided through the Services are generated by proprietary statistical algorithms and are intended strictly for educational, informational, and entertainment purposes.

Nothing on GLD Racing constitutes gambling advice, betting recommendations, investment solicitations, or financial advice.

3. Age Eligibility & Legal Compliance

You must be of legal adult age in your respective jurisdiction to access the Services: at least eighteen (18) years of age generally and in Hong Kong; nineteen (19) years of age in South Korea pursuant to Article 30 of the Korea Racing Authority Act (21+ on DerbyON); twenty (20) years of age in Japan pursuant to Article 28 of the Horse Racing Act; and twenty-one (21) years of age in North American jurisdictions where required. If you are under the statutory age, you are strictly prohibited from creating an account or purchasing passes.

You are solely responsible for ensuring that your access to and use of horse racing analytical data complies with all applicable local, provincial, state, and federal laws in your jurisdiction.

4. Proprietary Data Rights, Anti-Scraping & Commercial Restrictions

All content, GLD Speed Figures, GLD Speed Ratings, GLD Line odds projections, dynamic pace diagrams, track bias coefficients, pedigree ratings, and database architectures are the exclusive intellectual property of GLD Racing LLC, protected by international copyright and intellectual property treaties.

Purchased passes grant a strictly limited, revocable, non-exclusive, non-transferable license for your individual, personal, non-commercial wagering analysis only. You are EXPRESSLY PROHIBITED from: (a) scraping, crawling, spidering, data-mining, or harvesting data via bots, automated scripts, or APIs; (b) republishing, distributing, syndicating, or sublicensing any figures or past performances to third parties; (c) selling, reselling, or commercially exploiting any GLD Racing data; (d) ingesting, training, fine-tuning, or benchmarking artificial intelligence (AI), large language models (LLMs), or machine learning systems with our proprietary datasets; or (e) reverse-engineering our calculations. Unauthorized extraction or commercial resale will result in immediate permanent account termination without refund, IP blacklisting, and aggressive legal prosecution for damages and copyright infringement.

To the maximum extent permitted by law, GLD Racing LLC, its owners, operators, affiliates, and contributors shall not be liable for any direct, indirect, incidental, punitive, or consequential damages, including loss of profits or wagering losses, arising from the use or inability to use our data, software, or projections.

7. Pricing, Recurring Subscriptions, Cancellation & Refund Policy

Full-Day Pass ($5.00 USD / ¥800 JPY / ₩7,000 KRW / HK$40 HKD): A one-time, non-renewing purchase that unlocks every active track across all covered jurisdictions on the selected calendar date (YYYY-MM-DD). Monthly All-Access ($40.00 USD/mo / ¥6,000/mo / ₩52,000/mo / HK$300/mo): A recurring monthly subscription that automatically renews each monthly billing cycle until cancelled. When promotional code GLDSTANDARD is applied at checkout, the first month is billed at $20.00 USD (50% off) and automatically renews at the standard $40.00/mo rate thereafter unless cancelled prior to renewal.

Self-Service Cancellation & Refund Policy: You may cancel Monthly All-Access auto-renewal at any time before your next billing date with 1 click on /account via "Manage or Cancel Subscription" (Stripe Customer Billing Portal) or by emailing support@gldracing.com; access continues through the end of your current paid billing period. Because digital racecard data is delivered and unlocked instantaneously upon payment, completed Full-Day Pass and subscription billing charges are non-refundable once unlocked, except in cases of duplicate billing, verified technical non-delivery, or where required by applicable consumer protection laws.

8. Trademark & Nominative Fair Use Notice

The Hong Kong Jockey Club (HKJC), Japan Racing Association (JRA - 日本中央競馬会), National Association of Racing (NAR - 地方競馬全国協会), Korea Racing Authority (KRA - 한국마사회), Tokyo City Keiba (TCK), and related venue names are registered trademarks of their respective governing bodies. All references to racetracks, stakes races, horses, jockeys, trainers, and cards are used strictly for nominative, descriptive, and informational purposes. GLD Racing is an independent analytical publication and is NOT affiliated with, endorsed by, sponsored by, or operated by the JRA, NAR, HKJC, KRA, or any official racing jurisdiction.
